General terms and conditions and jurisdiction

These general terms and conditions apply to orders placed at the company J & W Börnecke GmbH & Co. KG.

The term ‘consumer’, in these terms and conditions, is meant to denote natural persons, who enter into a business relationship for purposes that are unrelated to commercial or professional activities.

References to ‘entrepreneurs’, in these terms and conditions, are meant to denote natural or legal persons, as well as judicial partnerships, who enter into a business relationship with our online shop for purposes of exercising their commercial or professional activities.

References to ‘costumers’, in these terms and conditions, are meant to denote both consumers and entrepreneurs.

Completion of contract

The contract is concluded, if the customer makes a binding purchase offer on the phone or via email and if the purchase offer is accepted on the part of J & W Börnecke GmbH & Co. KG.

In the case of initial contact, an order can only be placed by telephone, as advice is usually required.

By making a purchase offer, the customer confirms to have taken note of the terms and conditions and, in the case of consumers, the right of withdrawal.

The purchase offer is accepted on the part of J & W Börnecke GmbH & Co. KG in the following manner:

delivery of the goods to the customer or, via email, by means of sending a list of the ordered goods, the terms and conditions, and, in the case of consumers, additionally the right of withdrawal.

The deadline for the acceptance of a purchase offer is 4 working days. In the event that the deadline is exceeded without an acceptance of the purchase offer, as defined in these terms and conditions, the offer is deemed rejected.

Conditions of payment

For private consumers, payment can be made by advance payment only. For entrepreneurs, payment can be made by invoice. Other types of payment are not available.

We reserve the right to supply customers only on the condition of payment by means of either advance payment or payment in cash on collection.

In the case of advance payment, the customer has to pay the full balance due within 5 days of receiving the acceptance of the purchase offer. In the case of payment by invoice, the full balance due must be paid within 14 days.

Right of withdrawal

The right of withdrawal is solely reserved for consumers. Entrepreneurs may, within 8 days and by phone arrangement, return the purchased goods in exchange of a credit note.

The return costs are to be paid by the customer.

Storage of the text of the contract

We store the order, together with the product data and the customer details.

Presentation of products

Minor colour deviations are due to technical reasons and do not constitute a reason for complaint.

Reservation of proprietary rights

Until the full payment of the balance due, the goods remain our property.

Dispute settlement

The EU Commission provides a platform for out of court dispute resolutions, which you can find here. We are neither obliged nor willing to participate in a dispute settlement process at a consumer arbitration board.
